Frequently asked questions
Am I entitled to a lawyer from the moment of police custody?
Yes, Tunisian law provides for the assistance of a lawyer from the start of police custody for most offences. It is advisable to assert this right immediately and not to make statements without counsel.
What should I do after receiving a summons?
Do not face a summons alone, whether it comes from the police, the national guard or a judge. Contact a lawyer before the hearing so as to prepare your statements and understand what is being alleged against you.
Can a victim seek compensation in criminal proceedings?
Yes, a victim may join the proceedings as a civil party to claim compensation for their harm before the criminal court. This allows the public action and the compensation claim to be dealt with within the same framework.
